Michael Patane is an Associate Director and an experienced practitioner who is well regarded for his strong skills in tax interpretation, advising, tax administration and commercial agreements.
Michaels experience draws on his time in both legal and accounting firms and the public sector and explains complex information in language that is able to be clearly understood. He is a past partner of Clayton Utz, Deloitte, Deloitte Lawyers and held senior positions in the ATO including Deputy Chief Tax Counsel (Indirect Taxes) and GST National Counsel and Strategic Litigation. While with the ATO Michael established the compliance program for High Income Individuals Project which worked closely with the High Wealth Individuals.
Michael has good working relationships with the revenue authorities and knowledge of the ATO practices which has assisted him in the professional resolution of issues on a timely and beneficial basis for his clients.
While Michael practises across most areas of revenue law and State taxes his practice includes undertaking legal and tax due diligences, negotiating and documenting business sales and acquisitions, share sale and purchase agreements, corporate restructures, joint ventures, joint venture management agreements, service agreements, operation agreements, shareholder agreements, property developments, intellectual property agreements, warranties and indemnities, tax sharing and funding agreements.
Michael has successfully argued a number of precedential test cases and all of the decisions have been favourable confirming his technical views or resulted in new precedents.
Michael advises government, private corporations, multinational companies, private clients and charities. Regularly presents for the Tax Institute, Television Education Network and other bodies.
Michael is a Chartered Tax Advisor through the Tax Institute and is listed in Best Lawyers in Australia for Tax in 2015, 2016 and 2017. He is the Independent Director for the corporate trustee for the Western Capes Communities Trust.
