Mark Fatharly, Kott Gunning

Mark has over 22 years of experience acting as both counsel and instructing solicitor in commercial and general civil litigation in a range of courts and tribunals. He is also an accredited mediator, chair of the Society of Trust Estate Practitioners (STEP) in WA and Vice Chair of STEP Australia.

Mark has particular expertise in contentious trusts and estates, inheritance and estate issues, probate and executorship issues, trust administration, trustee obligations, mental capacity issues and guardianship and administration.

Mark’s litigation experience also includes contractual, leasing, construction and business disputes, injunctions, trade practices issues, debt recovery, liquor licensing, intellectual property and compliance with professional obligations as well as trust, inheritance and guardianship and administration applications.

He has also prosecuted and defended regulatory offences, overseeing the prosecution of more than 150 individuals per year for the protection of drinking water sources for the Water Corporation.  Litigating these matters requires him to have a detailed understanding of numerous areas of the law and the statutory environment impacting the clients and legal issues.

He has also advised and presented training to clients on a range of trade practices, privacy, financial services, credit legislation and other compliance issues.
